In this policy, “Office Performance Partners”, “we”, “us” and “our” refer to the organisation identified above.

2. Personal information we collect

We may collect and use:

your name, job title, organisation and professional contact details;

information you provide in an enquiry, contact form, email, telephone call, meeting or other correspondence;

information about an office asset, portfolio, project or potential instruction that you choose to provide;

client, supplier, contractual, billing and transaction information;

records of our professional relationship and communications;

limited technical and usage information about visits to our website, including information produced by Framer’s privacy-focused analytics; and

your communication and marketing preferences.

Please do not send special-category personal information or confidential personal information through the website unless we have specifically asked for it and agreed an appropriate method of transfer.

3. How we collect personal information

We collect information directly from you when you contact us, submit a form, meet with us, ask for a proposal or engage our services. We may also receive professional contact information from your organisation, mutual business contacts, professional advisers or publicly available professional sources.

Our website is hosted using Framer. If you submit a website form, the information is transmitted through the website and delivered to us so that we can respond.

4. How and why we use personal information

We use personal information to:

respond to enquiries and decide whether and how we may be able to assist;

prepare proposals, take pre-contract steps and provide agreed services;

manage client, supplier and professional relationships;

administer contracts, invoices, payments and business records;

operate, secure and improve our website and communications;

send relevant business-to-business communications where permitted by law;

establish, exercise or defend legal rights; and

comply with legal, regulatory, tax, accounting and professional obligations.

Our lawful bases are, as applicable: taking steps at your request before entering a contract; performing a contract; complying with a legal obligation; pursuing our legitimate interests in operating, protecting and developing our business and maintaining professional relationships; and consent where the law requires us to obtain it.

Where we rely on legitimate interests, we consider whether the processing is necessary, proportionate and compatible with your rights and reasonable expectations.

5. Business development and marketing

We may send relevant business-to-business communications to professional contacts where permitted by law and where we reasonably believe the content may be relevant. UK data-protection law continues to apply where we use information that identifies an individual, even when the communication is business-to-business.

You may object to direct marketing or ask us to stop contacting you at any time by emailing andrewmercer@officeperformance.co.uk. We may retain limited information on a suppression list so that we can respect your request.

6. Website analytics and cookies

We may use Framer’s built-in analytics to understand overall website usage and performance. Framer states that its built-in analytics does not use cookies or persistent identifiers. We do not currently use Google Analytics, Meta Pixel or advertising-tracking technologies on this website.

Our Cookie Policy provides further information.

7. Sharing personal information

We may share personal information where reasonably necessary with:

Framer and other website-hosting, form, information-technology, email, cloud-storage and communications providers;

professional advisers, including accountants, insurers and solicitors;

consultants, contractors and specialist advisers supporting an agreed assignment, subject to appropriate confidentiality and data-protection arrangements;

banks, payment providers and business-administration providers; and

regulators, courts, law-enforcement bodies or public authorities where disclosure is required or permitted by law.

We do not sell personal information.

8. International transfers

Some service providers may process personal information outside the United Kingdom. Where a restricted international transfer takes place, we use or rely on an appropriate legal safeguard, such as a UK adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved contractual clauses or another lawful transfer mechanism.

9. How long we keep personal information

We retain information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting and professional requirements. As a general guide:

routine enquiries that do not lead to an instruction may be retained for up to 24 months after the last meaningful contact;

client, project, contractual and professional records may normally be retained for up to six years after the relevant relationship or assignment ends;

financial and tax records are normally retained for at least six years;

marketing preferences and suppression records are retained for as long as reasonably necessary to respect your choices; and

aggregated website-usage information is retained in accordance with the settings and retention arrangements of the website platform.

We may retain information for longer where necessary to establish, exercise or defend legal claims or comply with a legal requirement.

10. Security

We use reasonable technical and organisational measures to protect personal information against unauthorised access, alteration, disclosure, loss or misuse. Access is limited to people and service providers who need the information for an authorised purpose.

No internet transmission or electronic-storage system can be guaranteed to be completely secure. Please contact us before sending highly confidential material so that an appropriate transfer method can be agreed.

11. Your rights

Depending on the circumstances, you may have the right to:

request access to your personal information;

ask us to correct inaccurate or incomplete information;

ask us to erase information;

request restriction of processing;

object to processing based on legitimate interests;

object to direct marketing;

request transfer of information in a portable format; and

withdraw consent at any time where processing is based on consent.

These rights are subject to legal conditions and exemptions. To exercise a right, email andrewmercer@officeperformance.co.uk. We may need to verify your identity before responding.

12. Data-protection complaints

You can raise a data-protection concern or complaint by emailing andrewmercer@officeperformance.co.uk or writing to the address above.

We will acknowledge a data-protection complaint within 30 days of receiving it. We will take appropriate steps to investigate without undue delay, keep you informed where appropriate and tell you the outcome.

You also have the right to complain to the Information Commissioner’s Office, the UK regulator for data protection.
